JURISPRUDENCE

The Supreme Court defines private detectives as privileged or documented witnesses, and adds in various rulings that they are "an instrument endowed with exclusivity for the effective control of the duties required of the worker." "The testimony given by private detectives is proven to be truthful; furthermore, it undeniably provides the precise and continuous dedication to the subject of the subsequent testimony to be given and the complementary graphic or audio accreditations that may accompany it." (STS 6-11-90). "The Administrative Litigation Division of the Supreme Court considers it legal for a public body to hire private detectives to investigate its public officials during working hours, since this does not violate the right to privacy" (STS 12-05-98).
